marks.lbr packages that work as you say do not use any pads.

When you specify a pad in your package, Eagle stops you from adding it to a

board if the schematic is open. I guess the logic is; if there is a pad

there must be a symbol for this device so you can only ADD into the

Schematic. If you close the schematic, add your fudicial and then open the

schematic, all will be well and still consistant.

You could create a fudicial symbol, and device. Place those into your

schematic

If you have the Sparkfun library, check out 'fudicial', they do it this way.
