DATES: This sweepstakes (“Sweepstakes”) runs from approximately September 13, 2010 – December 6, 2010, unless modified by element14 inc, 4801 N. Ravenswood Ave., Chicago IL 60640 USA (“Sponsor”).
WHO MAY ENTER: Open to all U.S. residents, age 18 and over. Employees of Sponsor, or any of its affiliate companies, subsidiaries, advertising and promotion agencies, and their family or household members, are not eligible.
HOW TO ENTER: There are 2 ways to enter: (1) Log-in at www.element14.com/community using your username and password; visit www.element14.com/TBHS and click on the “Enroll” button in the XBox banner to indicate your intent to enter the Sweepstakes drawing; or (2) If you are not already registered on www.element-14.com/community, you may do so upon entering the site; if you so elect at the time of registration, you will be eligible to be entered into the Sweepstakes. Alternatively, send a letter to the Sponsor address shown above with your name, contact information, and intent to enter the Sweepstakes.
For purposes of determining eligibility for website registrants, the “owner” of the email used to register at www.element14.com/community will be determined by who is the authorized account holder of the email address at the time of registration. The authorized account holder is the natural person who is assigned to the email address by an Internet Service Provider or other organization that is responsible for assigning email addresses or the domain names associated with email addresses. Purchasing a product on www.element14.com or any affiliate website will not increase your chances of winning.
HOW TO WIN: on or about December 7, 2010 a Sponsor employee will select one (1) winner, from all eligible entries received by conducting a random drawing. On or about December 7, 2010, the winner will be notified by telephone and/or email. The winner must meet the eligibility requirements set forth in these rules, and sign an affidavit of eligibility and liability/publicity release, where permitted by law, in order to qualify for the prize. Decisions of Sponsor are final in all matters relating to the selection of the winner in this Sweepstakes.
ODDS OF WINNING: The odds of winning depend upon the number of eligible entries received by Sponsor.
GRAND PRIZE: One (1) autographed Laptop modified by Ben Heck to operate Xbox 360 (“Grand Prize”). Approximate value of the Grand Prize is USD $500.00.
DISCLAIMER: By accepting the Grand Prize, the winner acknowledges that the Limited Warranty on the Xbox 360 Video Game System console (“Xbox 360”) incorporated in the Grand Prize has been voided due to modifications to the Xbox 360 made by Ben Heck. As a result, the Grand Prize is ineligible for repair by authorized repair centers of the original manufacturer of the Xbox 360. The Xbox 360 incorporated in the Grand Prize may also be protected by patent, copyright, trademark, trade secret and other similar intellectual property laws, and may also be subject to certain usage restrictions imposed by its original manufacturer. The winner is solely responsible for adhering to any intellectual property laws and usage restrictions applicable to the Xbox 360 incorporated in the Grand Prize and any other products he or she may use in conjunction with the Grand Prize.
Under no circumstances will Sponsor be responsible for any loss or damage—including personal injury, property damage or death—that may result from the winner’s acceptance or use of the Grand Prize. The winner assumes all risk and liability that may result from his or her acceptance or use of the Grand Prize. Sponsor, to the fullest extent permitted by law, disclaims any and all warranties, including the warranties of merchantability, non-infringement of third parties' rights (including without limitation third party intellectual property rights), and the warranty of fitness for particular purpose related to acceptance or use of the Grand Prize.
As long as the Grand Prize is properly claimed it will be awarded. Grand Prize is non-transferable, with no cash redemption or equivalent. Sponsor reserves the right to substitute a prize or prize component of equal or greater value should the Grand Prize or any component of Grand Prize become unavailable. All taxes on the Grand Prize are the sole responsibility of the winner. By participating in this Sweepstakes, and as a condition of entry into the Sweepstakes, entrants agree to release and hold harmless Sponsor and its parent company, affiliates, subsidiaries, officers, directors, agents and employees, from any and all liability whatsoever for any injuries, losses, or damages of any kind arising from or in connection with (1) awarding, acceptance, receipt, possession, use and/or misuse of the Grand Prize awarded herein; or (2) participation in the Sweepstakes or any prize related activities.
CLAIMING PRIZE: The winner must complete, sign and return an affidavit of eligibility and liability/publicity release, where permitted by law, within ten (10) days of receipt of Grand Prize confirmation or Grand Prize will be forfeited and an alternate winner selected. An unclaimed Grand Prize will be awarded in a random drawing to be held by Sponsor as necessary. By accepting Grand Prize, the winner consents to use of his or her name and/or likeness for all legitimate business purposes including advertising and promotional activities without additional compensation, unless prohibited by law.
PRIVACY/USE OF DATA: Sponsor will be collecting personal data about entrants in accordance with Sponsor's privacy policy, which can be found at http://www.element-14.com/community/themes/e14/pages/e14fullterms_en.html. By participating in this Sweepstakes, you agree to Sponsor's collection and usage of your personal information and acknowledge that you have read and accepted Sponsor's privacy policy.
MISCELLANEOUS CONDITIONS: All entries become the property of the Sponsor and will not be returned. By participating you agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which shall be final with respect to all issues relating to this Sweepstakes. Sponsor reserves the exclusive right at any time, without notice, to amend, add to, delete from, alter or otherwise changes these Official Rules. It is your responsibility to ensure that you have complied with all of the conditions contained in the Official Rules. Sponsor is not responsible for hardware or software failures of any kind; lost or unavailable network connections; failed, incomplete or garbled computer or telephone transmissions; typographical or systems errors; problems or technical malfunctions of any telephone network or lines, computer online systems, servers, providers or computer equipment; or technical problems or traffic congestion on the Internet or any combination thereof. Sponsor is not responsible for any injury or damage to entrant’s or any other person’s computer related to or resulting from the Sweepstakes or other telecommunications malfunctions, which may limit an entrant’s ability to participate. Sponsor may prohibit you from participating in the Sweepstakes or winning a prize, if in its sole discretion it determines you are attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair practices or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. If, for any reason, this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the control of Sponsor, which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. All issues and questions regarding the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor, shall be governed by, and construed in accordance with, the laws of the State of Illinois and the United States, without giving effect of any choice of law or conflict of law rules or provisions, which would cause the application of laws of any jurisdiction other than Illinois and the United States.
