Captions Competition Terms and Conditions

This competition ("the Competition") is run by element14 Pte Ltd ("the Promoter"). There will be a weekly draw where five winners will be selected for each of the four weeks in the month of February 2011 and an overall winner will be selected from amongst the weekly winners at the end of the fourth week.
By submitting your caption (the “Entry”) onto the Caption contest page ("the Site"), all participants ("Participants") will be deemed to have read, accepted and agreed to be bound by these Terms and Conditions ("Terms") which apply to the Competition. Participants are advised to print and keep safe a copy of the Terms. The Promoter reserves the right to revise the Terms from time to time. Revised Terms will be posted on the Site and it is a condition of entry to the Competition that Participants agree to comply with such amendments from time to time.

No purchase is necessary to enter the Competition.
Anyone who posts their caption on the Site as specified on the site between February, 10th 2011 and March, 7th 2011 will be entered into the Competition. Participant must be aged 18 or over as at March, 9th 2011. There is no limit to the number of entries that a Participant may post to the Site.
The timeline of each weekly contest is as follows:
1. 1^st week will be from 10^th February 2011 to 16^th February 2011
2. 2^nd week will be from 17^th February 2011 to 23^th February 2011
3. 3^rd week will be from 24^th February 2011 to 2^nd March 2011
4. 4^th week will be from 3^rd March 2011 to 9^th March 2011
The Entry that is selected by the panel of judges wins the contest.
No responsibility will be accepted for any entry which is not received for any reason, including technical error.
Judges’ decision is final and no correspondence will be entertained.
Winners will be notified by email (to the email address provided at the time of registration on the Site) by March 14^th, 2011. To claim his or her prize, the winner must confirm receipt of notification. If the winner does not respond within the specified time period, he or she will be deemed to have waived entitlement to his or her prize. Details of the winner will be posted on the Site on March 16^th, 2011.
The Promoter reserves the right to verify the eligibility of any winner before the Prize (as defined below) is issued and may require proof of identification and age. If the Promoter suspects fraud or misconduct, or if it is discovered that a Participant has failed to comply with the eligibility requirements set out in the Terms then the Prize may be withheld or withdrawn or another Prize winner may be selected.
By Participating in the Competition the winner assigns to the Promoter all existing and future intellectual property rights in each Entry submitted and all materials embodying such rights to the fullest extent permitted by law. Insofar as they do not so vest automatically by operation of law or under this Agreement, the Participants holds legal title in such rights on trust for the Promoter and undertakes to do all acts necessary to confirm that absolute title in all intellectual property rights in the Entry has been passed to the Promoter.
The prize for each weekly winner will be element14 2GB USB and the prize for the overall winner of the contest will be an EZ430 Chronos-433 ("the Prize"). The Prize is non-negotiable and non-refundable and no cash alternative will be offered. The Promoter reserves the right to substitute the Prize with a suitable equivalent and the free goods sent may differ from those advertised. There is no right to any refund in respect of free goods returned. Each winner must allow details regarding the winning of the Prize to be published in order to claim the Prize.
The Promoter reserves the right to withdraw or amend the Competition or extend the period of participation as necessary due to circumstances outside of its reasonable control. The Promoter will not be liable for any such withdrawal or change to the Draws.
Participants agree to be responsible for all applicable taxes, duties or other charges payable in relation to the Prize.
Employees, directors, shareholders of any company within the Promoter’s group of companies and their direct families (parents, siblings, spouse, partner, children) or agents and/or anyone associated with the running of the Competition are not eligible to enter the Competition.
Participants shall not be permitted to enter the Competition if by entering into it they may cause the Promoter and/or themselves to be in breach of any agreement (including but not limited to any contract of employment) to which they are a party or in breach of any law, regulation or rule having the force of law to which the Promoter or the Participant may be subject. The Promoter reserves the right to disqualify any entry made in breach of this condition.
The Promoter respects the policies of employers which forbid the acceptance of such prizes or prize money by their employees. The winner must obtain signed authorization from a director of his or her employer (if appropriate) confirming permission to accept the Prize.
The Promoter hereby excludes all and any liability arising out of the Competition or the acceptance, use, quality condition, suitability or performance of the Prize, even where arising from the Promoter’s negligence.
The Promoter does not exclude liability for death or personal injury arising from its negligence, or for breach or Part II of the Consumer Protection Act 1987 or for any matter in relation to which it would be illegal for the Promoter to exclude or attempt to exclude our liability.
The Competition and any dispute or claim arising out of or in connection with it or its subject matter shall be governed by and constructed in accordance with the law of England and Wales and the Participant irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the Competition.
