Export Paperwork (End User Undertaking)

I have ordered a BBB via AUS/NZ site ...yes another distraction.

 

I was surprised at the export documentation required for this, including this very interesting snip.

We further certify that the goods will not be used for any purpose connected with chemical, biological or nuclear weapons, or missiles capable of delivering such weapons; that they will not be re-exported or otherwise re-sold or transferred if it is known or suspected that they are intended or likely to be used for such purposes; and that the goods, or any replica of them, will not be used in any nuclear explosive activity or unsafeguarded nuclear fuel cycle activity.

 

Does anyone have any ideas why the BBB is subject to this 'End User Undertaking'

    I believe it has to do with US Commerce Dept. export control regulations,

    particularly implementing non-proliferation treaties.  There is a summary here:

    Mark, was this something you had to agree to before you could complete the purchase ?  There was a similar post to yours some months ago complaining of strange requirements for buying a BBB.

     

    Here in the UK I got a slip of paper stapled to the despatch note:

    Order code 2291620 is ECCN 5A002.a.1.a of the EU Dual-Use list (EC Regulation No. 428/2009 - Annex 1) and requires export authorisation if exported outside the EU'.

    but nothing to agree to up-front.  Interestingly you can buy a BBB from CPC who are part of Premier Farnell and you don't get any notice like this.  Also interesting in that you can buy things like the SL that would theoretically be far more useful in any of these supposed dual-use situations and get nothing at all...

     

    I wonder if the embest version of the BBB that coder27 found would attract the same requirements considering it's built in china rather than by circuitco in the US ?

    It seems to be a 'EU Export' paper and comes about because the AUS/NZ site is shipping it directly from the UK.

     

    If they think only BBB is capable, then perhaps there are a few others as well.

    The reality is anyone who was intending the 'undesirable' usage, is unlikely to fill it in correctly anyway.

     

    Yes It needs to be completed before being despatched.

    So I asked the following question to element14 in Australia (also covers NZ)

     

    Out of interest (and some on the element14 community forum).
    If the boards are stocked in AUS, is the same export declaration required.

     

    and received this reply

     

    Even if we have stock in our AU warehouse we still require the End User form for our records. Also the International Trade Compliance team need to check the form and then approve it for Element14 to be able to send the goods.

    It is a legal requirement that we have to comply with if we wish to sell certain parts.

     

     

    So seems that BBB is different to RPi or many other single board computers ....

    Actually that would make sense.

    The Texas Instrument downloads are similar, with those questions that any right minded hostile person is NOT going to answer properly.

    Perhaps the Embest BBB is restricted to China like the Egoman RPi.  Don't know.

     

    btw, for Egoman/RPi, China means "greater China", mainland China, Hong Kong,

    Macao, and Taiwan.  They are required not to show the FCC/EC markings,

    apparently in order to make it difficult to export to other countries.

     

    I think Egoman's product description is refreshingly clear with regard to use as a PC alternate.

    That's more of a marketing thing though isn't it.  We know that it's perfectly possible to build RPi in china and ship it to the rest of the world as they did exactly that for the first however many hundred thousands.  We know Embest can ship stuff outside China as they do with the likes of the SL.

     

    You'd expect that it'd be obvious to anyone with a little common sense that putting up barriers to getting hold of a BBB outside the US is going to cripple it's chance at success, especially when there are other boards available that don't attract this sort of additional hassle while being just as 'dual-use' capable. So you wonder why someone classified the BBB in this way, seems likely that it'd have to have been either beaglebord.org or circuitco..

     

    Do we know if the other beagleboards suffer from this too, or is it just the BBB ?
