Overlap error under IC

I have manually placed GND vias under the IC, but the DRC can't accept it,

showing Overlap error, like seen in the snapshot. Why?

    If you put vias ON smd pads, then you will always get drc error. I have

    been into the same problem when using a pcb battery holder where I wanted

    the smd to be the tallest point on the board, where I wanted the via

    inside the pad. I guess there is no other solution than to just approve

    that error.

     

    But will it work? I mean, will connect the pad to GND plane?
